Client Terms and Conditions

 

Big Creek Travel, LLC and its affiliates, collectively known as “Big Creek Travel”, act as agents for the client (“Client”) and the actual suppliers of travel services (“Supplier”).  As a result, when Client requests that Big Creek Travel purchase services on Client’s behalf, Client agrees to Supplier’s terms and conditions and the following:

Big Creek Travel is not responsible for acts or omissions of the Supplier or the Supplier’s failure to provide services or adhere to their own schedules.  Big Creek Travel assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Supplier; or (3) any wrongful or negligent acts or omissions on the part of any other party not under Big Creek Travel’s control. Additionally, Big Creek Travel is not responsible for airline schedule changes, denial of insurance claims, or Supplier policy changes.  Client hereby releases Big Creek Travel from all claims arising out of any problem covered in this paragraph.

 

Big Creek Travel encourages Client to plan ahead to avoid disappointment.  Big Creek Travel is not responsible for changes in Supplier’s prices before a deposit is placed on a reservation or changes in the Supplier’s inventory or availability.  

Client acknowledges and understands that: (i) airlines can increase their prices at any time before tickets are issued and that Big Creek Travel has no control over issuance of tickets for tours; (2) airlines, cruise lines, tour operators, and other Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and Client may be bound by those contracts regardless of whether he/she receives notice of their terms.  Additionally, client understands that the Supplier holds the policy regarding payment schedules, cancellation policies and refund policies, not Big Creek Travel. 

 

Big Creek Travel shall not be liable for any failure or delay in performance of its obligations or that of the Supplier under this Agreement arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including, without limitation, acts of God, strikes, equipment or transmission failure, pandemics, or any other event, whether similar or dissimilar to any of the foregoing, which could not have been prevented by Big Creek Travel.   

 

Big Creek Travel will provide all required disclosures to Client, however, Big Creek Travel has no special knowledge regarding the financial condition of the Supplier, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which Client may travel. For information concerning possible dangers at destinations, Big Creek Travel recommends contacting the Travel Warnings Section of the U.S. State Department at www.travel.state.gov. For medical information, Big Creek Travel recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel.

Client assumes full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements for his/her destination(s), including any barriers to entry due to criminal backgrounds, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). Client hereby releases Big Creek Travel from all claims arising out of any problem covered in this paragraph.

 

Client agrees that the courts in Forsyth County, Georgia, USA will be the exclusive jurisdiction for all claims brought by Client or Big Creek Travel, and Client hereby submits to the personal jurisdiction of those courts.

 

Big Creek Travel strongly recommends that Client purchases trip cancellation insurance and/or trip protection.  If Client elects not to purchase trip insurance/protection, Client understands that he/she is responsible for any cancellation penalties or non-refundable portions of the trip.  Additionally, client understands that Big Creek Travel is not an insurance broker and any questions regarding policies, coverage or claims must be referred to the issuing company.
